By availing Arc Attest's services, you agree to abide by these terms. Arc Attest reserves the right to modify these terms, and continued use of the services implies acceptance of any such modifications.
1. Acceptance of Terms
a) By availing any services from Arc Attest, you expressly accept and agree to the terms and conditions of this Agreement.
b) If you disagree with any part of these terms, conditions, and notices, you must refrain from using Arc Attest's services.
2. User Eligibility
a) Users must be of legal age to enter into a binding contract and not barred from availing services under the applicable laws.
b) Users will use the services only in accordance with the rights granted by this Agreement.
3. Purpose of Services
a) Users will utilize Arc Attest's services solely for employment/recruitment purposes or on behalf of their clients.
b) Information accessed by us shall be kept confidential and not shared with third parties.
4. Consent and Indemnification
a) Users shall obtain formal consent from individuals undergoing background screening.
b) Users indemnify Arc Attest against losses arising from third-party claims related to the absence, withdrawal, or expiry of consent.
5. Information Accuracy
a) Users undertake to provide correct and valid information for verification.
b) Arc Attest relies on the accuracy of information provided by users; any misrepresentation may result in cancellation of services.
6. Security and Compliance
a) Users must comply with applicable laws and regulations, including data protection laws.
b) Users shall maintain security measures to prevent unauthorized access to logins and applications provided by Arc Attest.
7. Responsibility for Verifier ID
a) Users are responsible for the security and control of Verifier ID (logins, identification codes, and passwords).
b) Users must immediately inform Arc Attest of any unauthorized use or disclosure of the Verifier ID.
8. Suspension and Reinstatement
a) Arc Attest may suspend the Verifier ID in case of breach, inability to verify information, infringement of third-party rights, or unauthorized use.
b) Arc Attest reserves the right to reinstate users after suspension, at its sole discretion.
9. Audit
a) Users agree to allow Arc Attest or its appointed auditor to audit operations and systems.
10. Conditions and Appeals
a) Users must satisfy all conditions specified in this Agreement.
b) Any appeal raised after 24 hours of a search will be treated as a new search, subject to applicable pricing.
